Counselor/ Aly Rizk President of Administrative Prosecution Authority (APA) explained the role of APA in fighting financial and administrative corruption in the state’s institutions in an interview with Al Yom Al Sabea Newspaper, especially in the crucial cases investigated by APA in 2016 where he also mentioned that APA’s new law is about to be finalized and presented to the Parliament.
What is the role of APA in fighting corruption?
APA fights corruption in the state’s administrative bodies through determining the disciplinary accountabilities of accused officials and issuing prompt decisions regarding any financial or administrative violations
What is your plan for the development of APA and enhancing its role in fighting corruption?
Since I became President of APA I have been keen on improving the technical performance and efficiency of APA members, activating their role in fighting corruption through applying strict penalties that achieve general deterrence and protect public funds from any violation or aggression where this plan has been sensed by citizens especially after APA starting taking prompt procedures against corruption incidents through the inspections conducted by APA in several governorates
Is there a new system set to receive citizens’ complaints?
First of all APA receives complaints presented by citizens on its hotline :16117 and email: This email address is being protected from spambots. You need JavaScript enabled to view it. also APA created accounts on various social networking websites to interact with citizens and soon APA’s Information Center will launch its android application to be used on cellphones beside its role in monitoring media means to detect any corruptions incidents under APA’s jurisdiction, present them to me in person and I refer them to the competent Prosecutions
Also there is a plan to increase the number of prosecution premises throughout the governorate to make it easier for citizens to present their complaints and appear before APA to listen to their hearings
What are the most important cases recently monitored by APA?
One of the most important incidents monitored by APA from media was broadcasting an old television interview with President/ Mohamed Abd Al-Fattah Al-Sisi instead of the new one by the Egyptian Television on the occasion of his excellency giving a speech before the United Nations General Assembly also the report broadcasted by one of the Talk Show Programs about severe corruption incidents at El Monshaa Hospital at Sohag Governorate where APA conducted an inspection on the hospital on the next day of broadcasting the program as well as the incident of a student who fell into a drainage outlet at school and many other cases.
When will the new law of APA be adopted? And what are its most important features?
The new APA was already prepared in coordination with Minister of Justice and Minister of Legal and Parliamentary Affairs and it is currently presented before the Parliament for voting, as for its features; it regulates the guarantees and immunities granted to APA members by the constitution, sets a specific system for the power granted to APA members in applying sanctions in disciplinary violations, where we also aim to extend APA"s jurisdiction over subsidiaries of holding companies and university hospitals as currently APA procedures are pending permission from University Presidents to investigate incidents related to hospital violations such as Al Kasr Al Einy Hospital and Abo Elrish Hospital, accordingly expanding APA competence will guarantee the rights of citizens as well as officials at those hospitals in an impartial investigation instead of the disciplinary committees formed at the university hospitals
Sometimes APA is charged for taking slow procedures regarding case investigations, what is your opinion?
“Prompt Justice” is one of the essential concepts that I always aim to ensure that APA members follow, since any delay in the investigation procedures is definitely not in favor of citizens and I would like to clarify that some investigations are conducted within a few days such as the case of doctors fighting during performing an operation with scalpels as Kafr El-Sheikh Prosecution conducted investigations in this incident in 15 days also the case of broadcasting an old television interview with President Abd Al-Fattah Al-Sisy where the headquarters technical bureau finalized the investigations in less than 10 days, on the other hand investigations might take a longer time not because of the members performance but the reason is forming committees especially to inspect financial violations and also where some defendants take longer time to present their supporting documents beside the procedural routine that APA is trying to overcome it by introducing office automation to the work system at APA

How will office automation help in achieving prompt justice?
Recently, APA signed a cooperation protocol with Ministry of Communication and Information Technology where one of the reputable companies in this field was assigned to prepare an electronic program especially designed for APA to connect different administrations and prosecutions together all over the republic, where this company is about to launch the first edition of this program that will facilitate taking the necessary procedures against violations for citizens and APA members and will expedite the process of finalizing cases besides through this program accurate statistics can be collected regarding any kind of violation in any governmental sector which would help decision makers in taking accurate decisions through the annual report prepared by APA and sent to the Republic’s Presidency.
How many corruption cases were investigated by APA during the current year?
Since the beginning of the year until this November 131,966 cases were investigated and 60% of them were finalized
Is there any other role for APA either than monitoring and investigating administrative corruption violations?
Beside APA’s punitive role there is a preventive role as after conducting and finalizing an investigation APA member does not just aim to prepare a memorandum to apply sanctions on violators but also he aims to issue rules and regulations that should be followed to avoid damage caused to public funds and set clear procedures that would ensure the non-repetition and prevention of this violation, as for instance in the prosecution’s investigations regarding Clatakizv medicine of hepatitis C that was bought by the Ministry of Health for 118 million pounds APA addressed the Prime Minister to take immediate procedures regarding the disposition of the medicine stock before it expires, also the investigations concluded by the Headquarters Technical Bureau concluded in cases regarding the distribution of subsidized goods and smart cards that there were erroneous procedures followed in this concern that led to the waste of billions of pounds, accordingly APA addressed the Minister of Supply to inform him that the ministry should rely on ID cards beside the smart card in disposing those subsidized goods to eliminate the phenomenon of issuing cards with fictitious names also APA recommended linking the smart cards database with the database of each of : social insurance, taxes authority and other authorities involved in this concern in order to accurately identify the eligibility of citizens while dividing eligible citizens into three categories .
