Senior Officials at Damietta Governorate Facing Trial after committing profound violations regarding the establishment of Casablanca Hotel at El-Basateen Village

     Counselor/ Mahmoud El-Hagrasy – Head of Damietta Technical Bureau approved to refer the following accused senior officials to immediate trial:

As investigations in Case No. 706 – Damietta Prosecution 2nd division – conducted by Counselor/ Gamal Eiad – Deputy of Damietta Technical Bureau, revealed the involvement of Former Secretary General of Damietta Governorate, Present, Former and Prior Head of Municipal unit of El- Basateen village, Head of Municipal unit of Kafr Saad City, Director and Secretary of Engineering Administration at Kafr Saad Municipal unit, Engineering Department officials at El-Basateen Village Municipal Unit, Organization Manager at Municipal unit of Kafr Saad City, Director of New Damietta industrial security Office, industrial security inspectors, Head of manpower office at New Damietta and inspector of manpower office at New Damietta of the massive violations in the process of establishing and operating Casablanca Hotel built of ten storeys without license and in violation of the required conditions and specifications for occupational, safety, health and civil protection and without obtaining a license from the Ministry of tourism.
The investigations revealed that the accused officials within their competence and during the period from 2005 till 2012 did not perform their work with due diligence, violated the law and caused damage to the state budget, also violated laws regulating construction and urban planning, occupational health, safety, laws and resolutions regulating the operation of installations and civil defense as follows:

1. Engineering Department, Municipal unit and organization officials:
? Failed to take necessary procedures regarding construction work at Casablanca Hotel which was established in violation to the law and without license at El-Basateen Village, Damietta Governorate.
? Failed to take necessary procedures regarding exceeding the building height, according to the building code, with five storeys.
? Did not notify the Municipal Unit regarding the incident of operating the hotel without obtaining both license and civil protection report as well as its non-compliance with the environmental health requirements, occupational and safety health requirements.
? Approved installing water stations to the hotel despite their knowledge of the above mentioned violations.
? Neglected to notify the General Investment Authority and Department of Environmental Affairs at the City Council of Kafr Saad that the mentioned hotel was built without license and exceeded height restrictions as well as its non-compliance with the necessary security conditions against fire risk with their intention to cover-up the illegality of the hotel’s establishment.
? Approved anonymous engineering drawings presented by the hotel owner, despite their knowledge that the mentioned hotel was built without license and exceeded height restrictions, what would enable the owner in collusion with the accused officials to issue preliminary and temporary approval for the hotel from the Ministry of tourism, despite the massive violations.
? Omitted issuing an administrative order to suspend the hotel despite of the previously mentioned violations and its serious threat on lives of workers and guests.
2- Industrial Security Officials:
? Failed to perform their work duties by following up El-Basateen village upon discovering that the hotel is operated without a license as well as its profound violation to the regulations set by industrial security and occupational health, besides neglecting setting a fire fighting plan and the hotel’s non-compliance with the regulations set by civil defense and civil protection.
? Neglected to submit a memorandum in order to administratively suspend the hotel during the period from 13/7/2008 to 15/10/2009 despite of the existence of substantial violations in this concern resulting in the continuation of the hotel operation as well as neglecting taking the necessary legal procedures against the hotel management as it did not perform a medical examination on workers as stated by law.
? Failed to submit an official report regarding the misdemeanor of operating an elevator without a license and also the lack of an elevator maintenance record.
? Failed to take the necessary legal procedures against the presence of exposed electricity wires threatening the lives of guests and workers in violation to the regulations set by industrial security.
? Neglected to take the necessary procedures for providing LPG gas regulators at the hotel in violation to the regulations set by industrial security.
3- Manpower officials at New Damietta
? Failed to take the necessary procedures in order to administratively suspend the previously mentioned hotel despite of the establishment, operation and employment violations.
4-General Secretariat at Damietta Governorate
? Enabled the owner of Casablanca Hotel and Company to obtain governmental approvals to issue a temporary license from the Ministry of Tourism despite of his pervious knowledge of the violations committed regarding the establishment and operation of the hotel.
Also the Prosecution ordered to officially notify the Ministry of Tourism and Damietta Governor to take the necessary procedures regarding suspending the hotel until it is reviewed by the Housing and Building National Research Center and the Technical Inspection Administration to inspect the safety of buildings affiliated to the Ministry of Housing at the expense of the hotel owner and the reconcilement of the hotel as soon as the technical reports prove its compatibility or taking the necessary legal procedures if otherwise is proven.
